Terms of Service

These Terms of Service govern the use of the Festival Zone platform at https://www.festival-zone.com (the “Platform”) between the operator (Finity In UG (haftungsbeschränkt), “we” / “us”) and users of the Platform (“Users”).

Conflicting terms of Users do not apply unless we expressly agree to them in writing.

Festival Zone is a discovery platform for festivals. Users may browse, filter, and view festival information. Registered organizers may create and manage festival listings within the technical capabilities of the Platform.

We do not guarantee any specific search or matching success. Third-party content (e.g. festival descriptions, prices, dates) may change; completeness or accuracy is not warranted.

Certain features require a user account. Registration details must be accurate and complete. Credentials must be kept confidential; suspected misuse must be reported to us without delay.

We may suspend or delete accounts if these Terms are violated, laws are broken, or the security of the Platform is endangered.

Users undertake in particular to:

• not post unlawful, misleading, or immoral content
• not infringe third-party rights (e.g. copyright, trademark, personality rights)
• not deploy malware, scraping attacks, or other disruptive technical measures
• keep festival information reasonably current and accurate (if acting as organizers)

Organizers provide content under their own responsibility. We may review, refuse, adjust (as needed for display), or remove listings, especially in case of legal violations or breaches of these Terms.

There is no entitlement to publication or to any particular placement.

We aim for continuous availability of the Platform but do not guarantee uninterrupted access. Maintenance, third-party outages, or force majeure may limit use.

Platform content (design, texts, brands, software) is protected by copyright and other rights. Users receive a simple, non-transferable right to use the Platform as intended.

By submitting content, organizers grant us the rights necessary to store, display, and technically process that content for operating the Platform.

We are liable without limitation for intent and gross negligence, under the Product Liability Act, and for injury to life, body, or health.

In cases of slight negligence, we are liable only for breach of essential contractual duties (cardinal obligations), limited to foreseeable, typical damage. Any further liability is excluded.

We assume no liability for third-party content or external links beyond the statutory limits.

Users shall indemnify us against third-party claims arising from content they submit or from culpable breaches of these Terms, including reasonable legal defense costs.

We may amend these Terms where required for legal, technical, or operational reasons. We will notify Users of material changes in an appropriate manner. If a User does not object within a reasonable period after notice, the amended Terms are deemed accepted, provided we have pointed this out separately.

The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

If any provision of these Terms is or becomes invalid, the remaining provisions remain in effect.
